Welcome to Sublimation Kings. These Terms & Conditions (“Terms”) govern your use of our website and the purchase of products from Sublimation Kings LLP (“Sublimation Kings,” “we,” “us,” or “our”).

By accessing our website or placing an order, you agree to these Terms in full.

1. Acceptance of Terms

By using this site or placing an order, you confirm that:

• You are at least 18 years old or have legal authority to enter into this agreement.
• You agree to be bound by these Terms and our Privacy Policy.
• You understand that all products are made-to-order unless otherwise stated.

2. Nature of Products — Made-to-Order

All Sublimation Kings products are custom-made or made-to-order.

Because of this:

• Products are created specifically for you after purchase.
• All sales are final, except in cases of verified manufacturing defects.
• We do not carry inventory for most items.

This allows us to offer:

• No minimums.
• Fully custom designs.
• Premium production quality.

3. Order Process & Approvals

3.1 Artwork & Proof Approval

For custom orders:

• A design proof may be provided prior to production.
• Customer approval of a proof constitutes final acceptance of:
  • Design
  • Colors
  • Spelling
  • Layout
  • Sizing selections

Once approved:

• No changes can be made.
• Customer assumes full responsibility for accuracy.

3.2 Customer Responsibility

You are responsible for:

• Correct spelling, names, and numbers.
• Proper sizing selection.
• Uploading high-quality artwork.
• Ensuring design accuracy before approval.

4. Production & Turnaround Times

Standard Production

• Typically 3–4 weeks:
  • From artwork approval for custom orders.
  • From payment for retail items.

Exceptions

• Batting gloves: 5–6 weeks.

Variability

Because all products are made-to-order:

• Production times are estimates, not guarantees.
• Timelines may vary due to:
  • Order volume
  • Complexity
  • Supply chain conditions
  • Seasonal demand

Some orders may ship sooner, while others may take longer.

Rush Orders

• Rush production, typically 10–15 business days, may be available.
• Rush availability is subject to:
  • Item type
  • Quantity
  • Production capacity
• Rush fees apply and are invoiced after order placement.
• Availability is not guaranteed.

5. Pricing, Sales & Promotions

All pricing and promotional terms are subject to the following conditions:

• All prices listed on the website are exclusive of shipping costs unless otherwise stated.
• Sale offers are not transferable and may not be redeemed for cash or credit.
• Sale offers do not apply to prior purchases and cannot be retroactively applied.
• Orders placed prior to a sale event are not eligible for price adjustments.
• Coupons or promotional codes may not be applied to orders during sitewide sales or promotional events unless explicitly stated.
• We reserve the right to modify, suspend, or cancel promotions, discounts, or sale events at any time without prior notice.

By placing an order, you agree to all pricing, promotion, and discount terms outlined in this policy.

6. Shipping & Delivery

Shipping Carriers

We primarily use major carriers such as:

• USPS
• UPS
• DHL

Delivery Estimates

• Shipping times are carrier estimates only.
• We are not responsible for carrier delays.

Risk of Loss

• Ownership and risk transfer to the customer upon shipment.
• Sublimation Kings is not responsible for:
  • Lost packages after shipment
  • Stolen packages
  • Incorrect addresses provided by the customer

7. Tariffs, Duties & Import Fees

Sublimation Kings is not responsible for any tariffs, customs duties, import taxes, brokerage fees, or other government-imposed charges that may apply to an order. These fees are determined by the destination country, state, or governing agency and are outside of our control.

Customers are solely responsible for any additional import-related costs incurred during or after shipment, including charges resulting from changes in trade policies, tariff regulations, or customs requirements.

Shipping carriers may require payment of these fees before delivery can be completed. Failure to pay applicable duties or tariffs may result in delayed delivery, returned shipments, or disposal of the package by the carrier or customs authority. Sublimation Kings is not responsible for refunds, replacement costs, shipping charges, or losses related to unpaid import fees or refused shipments.

Delivery timelines may also be affected by customs processing, inspections, or tariff-related delays, which are not considered production or shipping delays caused by Sublimation Kings.

8. Order Claims & Issue Resolution

8.1 Claim Window

All claims must be submitted within 72 hours of delivery.

8.2 Valid Claims Include

• Manufacturing defects.
• Incorrect item produced that does not match the approved proof.

8.3 Non-Valid Claims Include

• Incorrect sizing ordered.
• Customer-approved design errors.
• Color variation within acceptable tolerance.
• Normal wear or misuse.

8.4 Resolution

At our discretion, we will:

• Replace the item.
• Refund the item.
• Provide store credit.

Refunds are issued only when deemed appropriate by Sublimation Kings.

9. Color Variation Disclaimer

Due to the sublimation process:

• Colors may vary slightly from:
  • Digital proofs
  • Screens and devices
• Minor variations are normal and not considered defects.

10. Cancellations & Modifications

Because production begins quickly:

• Orders cannot be canceled or modified once placed.
• Exceptions may be granted at our sole discretion before production begins.

11. Payment Terms

We accept:

• Major credit cards
• PayPal
• Venmo
• Klarna
• Affirm

Fraud Prevention

We reserve the right to:

• Refuse or cancel any order.
• Request verification.
• Hold or delay suspicious transactions.

12. Chargebacks & Disputes

By placing an order, you agree to contact us first to resolve any issue.

Initiating a chargeback without contacting us:

• May result in account restrictions.
• May be disputed with supporting documentation, including proof approvals.

13. Intellectual Property

13.1 Customer-Provided Designs

By submitting artwork, you confirm:

• You own the rights; or
• You have permission to use the content.

You agree not to submit:

• Copyrighted material without authorization.
• Trademarked logos without permission.

You assume full liability for submitted designs.

13.2 Sublimation Kings Designs

All designs created by Sublimation Kings:

• Remain our intellectual property.
• May not be reproduced without permission.

14. Limitation of Liability

To the fullest extent permitted by law, Sublimation Kings shall not be liable for:

• Indirect, incidental, or consequential damages.
• Loss of profits or business interruption.
• Delays beyond our control.

Our maximum liability shall not exceed the total amount paid for the order in question.

15. Force Majeure

We are not responsible for delays or failure to perform due to events beyond our control, including:

• Natural disasters.
• Supply chain disruptions.
• Labor shortages.
• Carrier issues.
• Government actions.

16. Governing Law

These Terms shall be governed by the laws of the State of West Virginia, without regard to conflict of law principles.

17. Changes to Terms

We reserve the right to update these Terms at any time.

Continued use of the site constitutes acceptance of any changes.
